This Privacy Statement is effective immediately for Users registered after this date and will become effective for existing Users on January 1, 2020.

Nailyday EOOD (“Naylyday”, “we”, “us”), UIC: 206696082, with registered office at 15 Malin Todorov Street, Sofia, Bulgaria, respects your privacy and is committed to protecting it in accordance with this Privacy Statement. This statement describes:

• the types of information we collect when you access and use our Website – https://nailyday.shop/en and other online services (collectively, the “Services”); and
• our practices for collecting, using, maintaining, safeguarding and disclosing this information.

This Statement applies only to the information we collect through our Services, as well as in electronic communications sent through or in connection with our Services.

The definitions of terms in this Privacy Statement are referenced from the General Terms and Conditions of the Nailyday.shop Website.

Nailyday.shop is classified as a personal data controller in accordance with Regulation (EU) No. 2016/679 of the European Parliament and of the Council of 27 April 2017 (the “General Data Protection Regulation”). As such, we make every effort to comply with the obligations imposed on us by the General Data Protection Regulation.

Nailyday.shop strives to offer its visitors and Users the many advantages of Internet technologies and to provide an interactive and personalized experience. For these purposes, we, at Nailyday.shop, may use personally identifiable information – such as your name, email, address, phone number, etc., which are subject to this Privacy Policy. We, as you may assume, do not tolerate spam. Therefore, we will never sell, trade or rent your email addresses to unauthorized third parties.

Nailyday.shop has the right to collect and use information from and about its Users. The information through which the person can be identified may include any information that the User voluntarily enters, uses or provides when using the Services of the Website or submits when creating a User Profile. Nailyday.shop collects and uses the information for the purposes provided for in the General Terms and Conditions, as well as for offering new services to the User and familiarizing him with the new functionalities of the Website.

We collect two types of information from and about our Users, including information:

• about your internet connectivity, the device you use to access the Services and usage details (e.g. about your Internet Service Provider).

The information we collect through our Services may include:

We collect this information to fulfill the contract for the purchase and sale of products from the Website, as well as to verify the authenticity of your Profile.

2. HOW DO WE COLLECT USER INFORMATION?

6. ACCESSING AND CORRECTING YOUR PERSONAL INFORMATION.

We take reasonable steps to accurately record the personal information you provide to us, as well as any subsequent updates to it.

We encourage you to review, update and correct the personal information we hold about you. You may request that we delete your personal data that is inaccurate, incomplete, irrelevant for legitimate purposes or that is processed in a manner that violates applicable legal requirements.

7. SECURITY: HOW DO WE PROTECT YOUR INFORMATION?

Nailyday EOOD is registered as a Personal Data Administrator with the Personal Data Protection Commission of the Republic of Bulgaria.[ST2]

We have implemented appropriate measures in the form of various technical, physical and other means, including, but not limited to, means to secure our electronic systems and databases, locks, cabinets, safes, various access control devices and systems, fire alarm and fire extinguishing systems. These means are intended to enhance the integrity and security of the personal information we collect and maintain. However, please note that even the best security measures cannot guarantee the complete elimination of all risks. If we become aware of any breach, intrusion or threat to our security systems, we will notify you electronically so that timely precautions can be taken. In addition to email, you may also be notified by a notice on the Website if a security breach occurs.

8. CONTROLLING YOUR PERSONAL DATA

Other Users may identify you or associate you with your account if you provide your personal data or information in content that you post or make publicly available. You may reduce the risk of being identified if you use the Services under a pseudonym or nickname. However, in such a case, the credibility of your contributions to the Services may be reduced. Users may also find friends based on their names or email addresses. You can adjust your settings for this manually.

9. TERMINATION

As mentioned, you can review and change the personal information we maintain about you at any time by logging into your User Account settings or contacting Nailyday.shop. Upon request, we will deactivate or delete your User Account, as well as your contact information and personal data from our active databases.

This Privacy Policy is effective until terminated by either party. If you do not agree to be bound by this Privacy Policy, you must discontinue using the Nailyday.shop Website. If you are dissatisfied with Nailyday.shop, the content or any of its terms, conditions, statements or policies, your sole remedy is to discontinue using the Website. Nailyday.shop reserves the right to terminate or temporarily suspend your access to the Website, or parts thereof, without notice, if we determine in our sole discretion that your use is in violation of any applicable law or harmful to our interests, the interests of other persons or organizations or if Nailyday.shop believes that your use is in violation of this Privacy Policy or the General Terms.

10. PRIVACY FOR CHILDREN

Nailyday.shop does not knowingly collect personal information from children under the age of 13. If we learn that we have personal information about a child under the age of 13, we will delete that information from our servers. Nailyday.shop encourages parents to go online with their children.

11. CHANGES TO THIS DECLARATION

Nailyday.shop reserves the right to change this Privacy Policy at any time. Please check this page periodically for changes. Use of the Services following such changes or amendments to the Privacy Policy shall be deemed to be express acceptance of the amended/modified Privacy Policy and agreement to be bound by such amended/modified Privacy Policy. Information collected before the amendment took effect will be used in accordance with the rules and laws that were applicable at the time the information was collected.

12. APPLICABLE LAW

This Privacy Statement and the use of the Website are governed by Bulgarian law. If a dispute arises regarding this Privacy Statement, we agree to attempt to resolve it with the help of an agreed mediator in Sofia, Bulgaria. All costs and fees, other than attorneys’ fees, related to the mediation shall be borne equally by the parties. If reaching a mutually acceptable solution through mediation proves impossible, Nailyday.shop agrees to refer the dispute to the Sofia District Court.

13. COPYRIGHT

The copyright for the Website is owned by Nailday EOOD.

The texts, graphics, photos, animations, videos and clips visible on the Website are objects of copyright and part of the intellectual property of Nailday EOOD. Some of the aforementioned, located on third-party pages, may be the property of these third parties. In no case may these be reproduced, used, presented or made available without the express written consent of Nailday EOOD or the said third party. Any distribution of files acquired by Users under the General Terms and Conditions of the Website, or parts of such files, constitutes a violation of the relevant laws for the protection of intellectual property and is prosecuted by law.

Nothing contained on the website may be deemed to grant a license or right to use, as a trademark, without the prior express written consent of Nailday EOOD.

14. OTHERS

Nailday EOOD is managed, controlled and administered entirely in Sofia, Bulgaria.

If you use the Nailyday.shop Website outside of this jurisdiction, please note that you are transferring your personal information to Nailyday.shop in Bulgaria and, by using the Website, you consent to the data transfer, as well as to comply with applicable law regarding your use of the Website and your agreements with us.
This statement and the policies outlined in this Privacy Statement are not intended to create and do not create any contractual or other legal rights on behalf of either party.

Nailyday.shop may provide a translation of the Bulgarian version of this Privacy Statement into other languages. You understand and agree that the translation of the Privacy Statement into other languages ​​would be solely for your convenience and that the Bulgarian version shall govern your rights and obligations. In the event of any inconsistency between the Bulgarian version of the Privacy Statement and any of the translations, the Bulgarian version shall prevail.
